If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, if special categories of data are processed in accordance with Art. 9(1) GDPR. In the case of express consent to the transfer of personal data to third countries, data processing is also based on Art. 49(1)(a) GDPR. Consent can be withdrawn at any time. If your data is required to fulfill a contract or to carry out pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data if it is required to fulfill a legal obligation on the basis of Art. 6(1)(c) GDPR. Data processing may also be based on our legitimate interest pursuant to Art. 6(1)(f) GDPR. The relevant legal bases in each individual case are explained in the following paragraphs of this privacy policy.

Recipients of personal data

In the course of our business activities, we work with various external parties. In some cases, this also requires the transfer of personal data to these external parties. We only pass on personal data to external parties if this is necessary for the fulfillment of a contract, if we are legally obliged to do so (e.g. passing on data to tax authorities), if we have a legitimate interest pursuant to Art. 6(1)(f) GDPR in passing it on, or if another legal basis permits the data transfer. When using processors, we only pass on our customers’ personal data on the basis of a valid data processing agreement. In the case of joint processing, a joint processing agreement is concluded.

Withdrawal of your consent to data processing

Many data processing operations are only possible with your express consent. You can withdraw consent you have already given at any time. The lawfulness of the data processing carried out until the withdrawal remains unaffected by the withdrawal.

Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)

IF DATA PROCESSING IS BASED ON ART. 6 ABS. 1 LIT. E OR F GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENSE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21 ABS. 1 GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS ASSOCIATED WITH SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21 ABS. 2 GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, their place of work or the place of the alleged violation. The right to lodge a complaint is without prejudice to any other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Information, correction and deletion

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, if applicable, a right to correction or deletion of this data. You can contact us at any time about this and any other questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us about this at any time. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the review, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of its deletion.
  • If you have lodged an objection pursuant to Art. 21(1) GDPR, your interests and ours must be weighed against each other. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a member state.

SSL/TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator, this site uses SSL/TLS encryption. You can recognize an encrypted connection by the fact that the browser’s address bar changes from “http://” to “https://” and by the lock symbol in your browser bar.

If SSL/TLS encryption is activated, the data you transmit to us cannot be read by third parties.

4. Data collection on this website

Cookies

This website does not set any cookies for visitors and does not store any other information on your device. The audience measurement with Koko Analytics also works without cookies (see below).

Cookies are only set when an administrator logs in to the protected area of this website. These cookies are technically required for logging in (Section 25 (2) no. 2 TDDDG, Art. 6 (1) (f) GDPR) and do not affect visitors.

When you click a purchase button, you leave this website and go to the Freemius order form. Freemius is responsible for the cookies used there (see “Purchases via Freemius”).

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website – for this purpose, the server log files must be collected.

Inquiries by email, phone or fax

If you contact us by email, phone or fax, your inquiry, including all resulting personal data (name, inquiry), will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent.

This data is processed on the basis of Art. 6(1)(b) GDPR if your inquiry is related to the fulfillment of a contract or is necessary to carry out pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of inquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; consent can be withdrawn at any time.

The data you send to us via contact requests will remain with us until you ask us to delete it, withdraw your consent to storage or the purpose for storing the data no longer applies (e.g. after your request has been processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

Audience measurement with Koko Analytics

We use the WordPress plugin Koko Analytics to understand which pages of our website are viewed and how often. Koko Analytics runs entirely on our own server. No cookies are set, no IP addresses are stored and no data is transferred to third parties. Only anonymous, aggregated page views and referral sources are recorded.

Processing is based on Art. 6(1)(f) GDPR. We have a legitimate interest in the anonymized analysis of user behavior in order to improve our offering.

Fonts

The fonts used on this website are hosted locally on our server. When you open the page, no connection is made to servers operated by Google or other providers.

5. E-commerce and payment providers

Processing of customer and contract data

We collect, process and use personal customer and contract data to establish, define the content of and amend our contractual relationships. We collect, process and use personal data about the use of this website (usage data) only insofar as this is necessary to enable the user to use the service or to bill for it. The legal basis for this is Art. 6(1)(b) GDPR.

The customer data collected will be deleted after the order has been completed or the business relationship has ended and any applicable statutory retention periods have expired. Statutory retention periods remain unaffected.

Data transfer when concluding contracts for services and digital content

We only transfer personal data to third parties if this is necessary in the context of processing the contract, for example to the credit institution commissioned with payment processing.

No further transfer of data takes place, or only if you have expressly consented to the transfer. Your data will not be passed on to third parties without your express consent, for example for advertising purposes.

The basis for data processing is Art. 6(1)(b) GDPR, which permits the processing of data for the fulfillment of a contract or pre-contractual measures.

Purchases via Freemius

The sale of our Pro licenses, payment processing, invoicing and license management are handled by Freemius Inc., 4023 Kennett Pike, Wilmington, DE 19807, USA (hereinafter “Freemius”). Freemius acts as a reseller (Merchant of Record). When you click a purchase button, you are taken to the Freemius order form. There, the data required for the purchase is collected, in particular your name, email address, billing address, VAT ID if applicable, and payment details. Card payments and PayPal are processed by the respective payment service providers.

For license management, Freemius transmits your name, your email address and details of your order and license to us. The data transfer to the USA is based on the Standard Contractual Clauses of the EU Commission. For details, please refer to the Freemius privacy policy: https://freemius.com/privacy/.

The legal basis is Art. 6(1)(b) GDPR (performance of a contract and pre-contractual measures).

Customer account

You can view licenses, downloads and invoices via the Freemius customer account (users.freemius.com). The customer account is operated by Freemius; the information above applies.

6. The “Replace External Images” plugin

Voluntary data transfer from the plugin

Our WordPress plugin “Replace External Images” uses a software component provided by Freemius Inc. (address under “Purchases via Freemius”). After activation, the plugin asks whether you agree to the transfer of data. Only if you agree, it sends the following to Freemius: name and email address of the logged-in administrator, the website address, the language, the versions of WordPress, PHP and the plugin, and events such as activation, deactivation and uninstallation, including a reason if you choose to give one. A list of installed plugins and themes is only sent if you agree to this separately.

We use this data to inform you about security and feature updates, to provide support and to improve the plugin. The legal basis is your consent (Art. 6 (1) (a) GDPR). You can withdraw it at any time by ending the data transfer in the plugin (“Opt out” in the plugin list) or by writing to plugins@hansandfriends.de.

The plugin works fully without your consent. It always downloads external images directly from your server from the respective image source, without passing through us or Freemius.

License check for Pro

If you have purchased Pro, the plugin sends the license key, the website address and the versions of WordPress, PHP and the plugin to Freemius to check and manage your license. This is necessary to fulfil the purchase contract (Art. 6 (1) (b) GDPR). For the transfer to the USA, the information under “Purchases via Freemius” applies.
